1. scope

(1) The Terms of Use published here apply in their current version in connection with the performance of any actions of use on the RealWise platform. RealWise offers its users to document processes and measures in a condominium owners' association and to exchange information about them between the owners, with the administrator and third parties. RealWise is a service of Articulao GmbH, Frankfurt am Main.

(2) The data protection regulations are governed by RealWise's Privacy Policy, which can be accessed here.

 

2. provision

RealWise is not liable for technical malfunctions, in particular for server or communication link failures, for delays in the use of the services or for the interruption of the services or their communication links. Nevertheless, RealWise always endeavors to ensure trouble-free operation of the services.

 

3. contents of RealWise

The own content provided by RealWise has been selected and created to the best of our knowledge and belief. However, RealWise does not assume any liability or guarantee for the completeness, correctness, compliance with legal regulations or up-to-dateness.

 

4. third party content

Content posted to RealWise's services by users or third parties reflects the opinions of those users or third parties. RealWise does not adopt this content as its own. RealWise neither has to nor can check the content posted by users and third parties, monitor it or point out any illegal actions. If users or third parties post hyperlinks in the services of RealWise that refer to content not posted by RealWise, RealWise does not adopt this content as its own. RealWise neither has to nor can check these hyperlinks and their linking target.

 

5. knowledge of violations of the law

(1) Users and, if applicable, third parties have the option of informing RealWise of a suspected legal violation by means of a function provided by RealWise for this purpose.

(2) In particular, RealWise does not tolerate any content that is extremist, racist, glorifies violence or pornographic, or content that offends the sense of decency of all fair and just thinkers. In the event that RealWise becomes aware of legal violations by content in connection with the services offered by RealWise, RealWise will immediately block or remove such content. However, RealWise reserves the right to conduct a review of such content prior to taking any action.

(3) Any liability of RealWise for the content of users or third parties shall take effect at the earliest from the time of becoming aware of an infringement of the law.

 

6. communication functions for users

(1) On the RealWise platform, registered users have the opportunity to communicate with other users within the framework of the concerns of their own homeowners' association. RealWise assumes no responsibility for this communication and any comments posted by users. This is the sole responsibility of the users. RealWise merely provides the infrastructure for this communication.

(2) It is pointed out to the user that this platform primarily serves the exchange between apartment owners and the administrator.

(3) Furthermore, the user is informed that an exchange with other persons is only legitimate if there is a legitimate interest for this.

(4) Insofar as a user posts corresponding comments within the scope of this communication, he/she declares his/her unrestricted consent to their processing, storage, publication, dissemination and making available to the public in terms of time, place and subject matter. The user can only revoke this consent for good cause. In this case, RealWise is prepared to delete the comments specifically named by the user.

(5) RealWise may, in particular, block this communication function temporarily or completely if a user is suspected of violating the rules. RealWise may also delete comments made by a user. Users have no right to unrestricted use of the communication function.

(6) RealWise has the unrestricted right to check content posted by the user at any time, regardless of its nature, in particular for rule violations. If RealWise has reasonable suspicion that content posted by the user violates one or more rules, RealWise reserves the right to temporarily hide this content from the platform without justification. If it is determined during the review that the content violates at least one rule, RealWise reserves the right to completely remove this content from its offer. RealWise decides at its own discretion whether and in what form the user will be informed about the hiding or removal and, if applicable, whether the user will be given further reasons for this.

(7) The respective user undertakes to accept the applicable law and not to violate it under any circumstances. This includes, in addition to the criminal norms, in particular those of data protection law. The user undertakes not to post content that is extremist, racist, glorifies violence or is pornographic. Furthermore, the user undertakes not to violate any personal rights and, in particular, the trademark, patent and copyright rights of third parties. The respective user is liable for the content posted by him, in particular comments.

(8) If a user publishes or distributes hyperlinks within the scope of communication via the RealWise platform, the user undertakes to carefully check the linked content beforehand.

 

7. exclusion of users

(1) RealWise reserves the right to exclude individual participants from the platform temporarily or permanently. A permanent exclusion takes place if the user repeats a violation despite a prior warning. Immediate exclusion is possible if the user violates criminal laws, namely posts insulting, defamatory or violence glorifying content.

 

(2) RealWise decides at its own discretion whether and in which form the user will be informed about his exclusion and whether he will be given reasons for this.

 

8. copyrights

Any content posted by RealWise or individual users is generally protected by copyright. Use, in particular reproduction, of the content posted on the RealWise platform is generally only permitted with the prior consent of the copyright holder. Without such consent, the use of content is generally permissible for private use, unless the use is directly or indirectly for commercial purposes.

 

9. modification or termination of the platform

RealWise reserves the right to adjust the Platform in whole or in part or to terminate the Service permanently with at least six months' notice.

 

10. final provisions

The exclusive place of jurisdiction for all disputes arising from this usage relationship is Frankfurt am Main/Germany, provided that the user is a merchant or does not have a general place of jurisdiction in Germany; this also applies in the event that, after conclusion of the contract, the user's place of residence or usual abode is moved out of Germany or the place of residence or usual abode is not known at the time the action is filed.

The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods and German international private law.

If any provision of these Terms of Use is or becomes invalid in whole or in part, the remaining provisions shall remain unaffected.
