What are the tasks of good condominium management? - The legal formulation that the administration must comply with the interests of the entirety of the condominium owners according to equitable discretion remains in general. For proper administration, the law requires, among other things
- the establishment of house rules,
- the proper maintenance of the common property,
- the adequate insurance of the common property at replacement value,
- the accumulation of an appropriate maintenance reserve and
- the setting of advances, i.e. an economic plan.
This list is not exhaustive. Since not every individual case can be regulated by law, the courts have dealt with a number of issues, e.g.
- Under what circumstances can three settlement offers be waived?
- How extensively and repeatedly may owners inspect the management documents?
- To what extent can liquidity bottlenecks be bridged by a limited withdrawal from the maintenance reserve?
The more constructive and open you can be with your administration, the easier it is to resolve many issues with common sense. What are your experiences, or do you have a question? We look forward to hearing from you!
